These Terms and Conditions ("Terms") govern your use of the Fish&Dish mobile application ("App") and all related services (collectively, the "Services") provided by Trawelt Consulting d.o.o. ("we," "us," or "our"), a company registered in Croatia with PIN: 78257735485 and registered address at Vlaška 72c, 10 000 Zagreb.

By downloading, installing, or using our App, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our App.

• "Account" means the account you create to access and use the Services.
• "Content" means any information, text, graphics, photos or other materials uploaded, downloaded, or appearing on the Services.
• "Subscription" means the recurring payment plan that grants access to premium features of the App.
• "User," "you," and "your" refer to the person accessing or using the Services.
• "User Content" means content that users upload or transmit to the Services, including seafood images for identification.

To use certain features of the App, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or any other breach of security.

The App uses artificial intelligence to identify seafood from user-uploaded photos. While we strive for accuracy, we cannot guarantee 100% accurate identification. You should not rely solely on our identification for health-critical decisions, particularly regarding edibility or potential allergens.

The App provides recipes and cooking suggestions based on identified seafood. These recipes are for informational purposes only and should be prepared at your own risk.

The App offers a free trial period, after which continued use requires a paid subscription. Subscription details, including pricing and duration, will be clearly displayed before purchase.

Payments are processed through Google Pay or Apple Pay, depending on your device. We do not store your payment information.

• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Payment will be charged to your Google or Apple account at confirmation of purchase
• Subscriptions may be managed by you and auto-renewal may be turned off in your account settings

Refund policies are subject to the respective terms of Google Play Store or Apple App Store. Generally, we do not process refunds directly.

You retain ownership rights in your User Content, including seafood images you upload. However, by uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content for the purposes of:

• Providing the Services
• Improving our AI identification algorithms
• Marketing our Services (only with your explicit consent)

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use.

You agree not to:

• Use the Services for any illegal purpose
• Upload false, misleading, or fraudulent content
• Attempt to access other users' accounts
• Circumvent or modify the App's security features
• Use automated systems to access the App
• Reverse engineer or attempt to extract the source code of the App
• Use the App to identify protected or endangered species for illegal purposes

You must not upload content that:

• Infringes intellectual property rights
• Contains illegal, harmful, or offensive material
• Contains personal information of others without their consent
• Attempts to mislead or deceive other users or our AI system

The App, including all content, features, and functionality, is owned by Trawelt Consulting d.o.o. and is protected by copyright, trademark, and other intellectual property laws.

If you provide feedback or suggestions about our Services, you grant us the right to use that feedback without restriction and without compensation to you.

You may terminate these Terms at any time by deleting your account and discontinuing use of the App. This does not automatically cancel your subscription - you must do this separately through Google Play or App Store.

We may terminate or suspend your account and access to the Services immediately, without prior notice, if you breach these Terms.

The Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

While our AI strives for accuracy, we make no warranties regarding the accuracy of seafood identification. Users should exercise caution and not rely solely on our identification for determining edibility or potential allergens.

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the Services.

You agree to defend, indemnify, and hold harmless Trawelt Consulting d.o.o., its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the Services.

We may modify these Terms at any time. We will provide notice of significant changes through the App or by other means. Your continued use of the Services after such modifications constitutes your acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with the laws of Croatia, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Croatia.

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
